You need to get a license from the copyright holder, and no, the work does not need to be registered for them to grant you a license.

from my research i found that that would be a derivative work correct? It said thought that the only people that could make a derivative work were the author and someone who obtained rights from the
author..
My question is how do I legally go about obtaining rights?
Are there any forms to fill out?

Note- the girl gave me permission to use the story on my website.. but..
Since you automatically obtain copyright when you write something is there anyway I can get the copyright from her
even though it is not registered?
