Not true. If she was an employee the employer owns the work.
: : Is is illegal to produce an "Artist Portfolio" website that would include artwork produced for a past or present employer without the company's consent?
The issue is whether the artist or the employer owns the copyright to the works. This is determined by either a written agreement between you and the employer regarding ownership of copyright. Absent such an agreement, you may be subject to the "works-for-hire" doctrine, which provides that if you are hired to create a work by an employer and your creation fits within the scope of your employment, the copyright belongs to the employer. Even if the employer owns the copyright, they may be willing to give you permission to use the material on your website.
